I would file a consumer protection case with PROFECO. I found that in my case, the credit card companies are in league with the resorts, so you will not receive any assistance from them. Bank of America told me that as soon as I signed the credit card receipt, the purchase was completed, and due to "international law" regulations, there is little that can be done to obtain a refund, after you sign the credit card receipt. I remember during one telephone conversation with Bank of America, one of the representatives, actually tried to talk me into completing the purchase with La Jolla, after I told them that the contract had been breached on June 17, 2008. PROFECO assisted me in obtaining my full refund, it took two years, but the Mexican Federal government assisted me successfully.
